Supplemental Terms and Disclaimer

These Supplemental Terms apply to your use of the Cold Creek Pigging Simulator(the “Simulator”), a web application operated by Ironclad Digital LLC (“Ironclad,” “we,” “us”), and are in addition to the Ironclad Terms of Use. By creating an account or using the Simulator, you agree to both.

The Simulator is delivered in a browser rather than through an app store, so no store license agreement applies to it. Where these Supplemental Terms and the Terms of Use conflict, these Supplemental Terms control for the Simulator, because they speak to what this specific product does and does not do.

1. A simulation, for evaluation and practice

The Simulator exists so that a person can practice the decisions involved in pigging a gathering line, and so that an organization can evaluate whether a tool of this kind is worth having, in a place where being wrong costs nothing. It is not a working tool. Do not plan, schedule, execute, or justify a real pig run with it.

It is not engineering design software, it is not a process simulator, and it does not produce a certified, stamped, or qualified result. Ironclad makes no representation, warranty, or guarantee that any output is suitable for design, for operational planning, for regulatory submission, or for any purpose requiring engineering certification.

2. The physics is illustrative, not calibrated

The Simulator models pig movement, liquid accumulation, friction and stuck conditions well enough to behave plausibly on screen and to teach the shape of the problem. Its coefficients are not calibrated against field data from your lines or anyone else’s. Where a value is sourced from published work, the repository records that source, and where it is not, the repository says so. Known limitations of the model are recorded rather than hidden.

Treat every number it produces as an illustration of a relationship, not as a prediction about a real line.

3. Pressure figures are simplified estimates

Pressure values shown are simplified design-pressure estimates. They are not MAOP determinations. A real maximum allowable operating pressure under 49 CFR 192.619 is the lowest of design pressure, test-pressure history, and prior operating pressure; the Simulator computes the first of those only, from values you typed in.

Remaining-strength output is a worked example of a published method applied to simulated geometry. It is not a fitness-for-service determination and must never be used to schedule, defer, or decline a repair.

4. Nothing it produces is a record

Exports, worksheets, and telemetry logs are simulation output. None of them is a 49 CFR 192.517 pressure-test record, a certificate, an inspection record, or evidence of anything having been done. They carry no signature block and must not be filed, submitted, or presented as though they document real work.

5. Not a qualifying program

Use of the Simulator does not satisfy, replace, or evidence any requirement under Operator Qualification rules in 49 CFR Part 192/195, Process Safety Management training under OSHA 29 CFR 1910.119, EPA Risk Management Program training under 40 CFR Part 68, Canada Energy Regulator rules, or any equivalent state or provincial standard. It does not generate documentation that satisfies the record-keeping requirements of 1910.119(g)(3) or any OQ task-evaluation record.

Verify qualification, training, and record-keeping requirements with your compliance team before using the Simulator in any formal program.

6. Never the basis for a real decision on a real line

Pigging is hazardous work. A stuck pig, a hydrate, and a blowdown are all situations where getting it wrong injures or kills people. Do not use anything the Simulator shows you as the basis for a decision on a live line, including whether to launch, what differential to pull, how to work a stuck pig, or how to blow a line down. Follow your employer’s approved procedures, your training, and the judgment of the qualified people on site.

7. Not engineering, safety, or professional advice

Nothing in the Simulator, its outputs, its citations, or its documentation constitutes engineering advice, safety advice, regulatory guidance, or professional advice of any kind. Ironclad is not an engineering firm, does not offer or perform engineering services, and is not engaged in the practice of engineering. No engineer client, consultant, or professional relationship is created by your use of the Simulator, and no output has been reviewed, approved, sealed, or stamped by a licensed professional engineer.

Where the Simulator cites a standard or a published source, that citation is provided for your own review. Ironclad does not control those sources, does not warrant their content or availability, and does not endorse any conclusion you draw from them. Inline-inspection velocity guidance shown in the Simulator is generic; your ILI vendor’s tool specification governs and overrides anything shown here.

8. Assumption of risk

You understand that gathering and midstream operations are inherently hazardous, and that the Simulator may show a result that is inaccurate, that rests on a simplification that does not hold for your conditions, or that is wrong because of an input error. You knowingly and voluntarily accept the risk of relying on any output, and you accept responsibility for verifying anything you take from it against your employer’s approved methods. You agree that you are in a better position than Ironclad to judge whether the Simulator is appropriate for what is in front of you.

9. Your account

The Simulator requires an account. You are responsible for keeping your credentials confidential and for activity under your account. Do not share an account, and tell us promptly if you believe it has been accessed by someone else. We may suspend or close an account that is being used to abuse the service or in a way these terms prohibit.

10. Your data and data loss

What we store and who processes it is described in the privacy policy. The Simulator does not need real line data to work, and we did not build it expecting any. If you choose to enter details of a real line, you are responsible for whether your employer permits that.

The Simulator is not a system of record and is not a backup. To the maximum extent permitted by law, Ironclad is not liable for lost, corrupted, deleted, or inaccessible saved runs, whether caused by the Simulator, a service provider, your browser, your connection, or any other cause. Keep your own copy of anything you care about.

11. Availability

The Simulator is provided as an evaluation and practice service. We do not promise any level of uptime, and we may change, suspend, or discontinue it, in whole or in part, at any time. Where we discontinue it entirely, we will make a reasonable effort to give notice so you can retrieve anything you want to keep.

12. Acceptable use

Do not attempt to gain access to another account or to data that is not yours, probe or disrupt the service, scrape it in bulk, resell or sublicense access, or present its output as a real record, certification, or evidence of completed work. Do not represent the Simulator or its output as an Ironclad certification of anything.

13. Disclaimer of warranties and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SIMULATOR IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, AND IRONCLAD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRONCLAD’S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SIMULATOR SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR ACCESS IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY DOLLARS ($50.00).

Nothing in these Supplemental Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages; in those jurisdictions the exclusions and limitations above apply only to the greatest extent those laws permit, and you may have additional rights.

14. Indemnification

You agree to indemnify and hold harmless Ironclad, its members, managers, and contractors from any third-party claim, damage, or expense, including reasonable attorney fees, arising from (a) your use of the Simulator in a manner that violates these Supplemental Terms, the Terms of Use, or applicable law, (b) your use of the Simulator for a purpose it expressly disclaims, including planning or executing work on a live line or supporting a regulatory or qualification record, or (c) your violation of any right of a third party, including disclosure of line data you were not permitted to enter. This obligation does not apply to the extent a claim arises from Ironclad’s own negligence or willful misconduct, and does not apply where prohibited by applicable law.

15. Changes

We may update these Supplemental Terms. The current version and its effective date are always posted here. When we make a material change, we will say so rather than quietly reposting, and continued use after that constitutes acceptance.

16. General

If any provision of these Supplemental Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remaining provisions will remain in full force and effect. Ironclad’s failure to enforce any provision is not a waiver of it. These Supplemental Terms, together with the Terms of Use and the privacy policy, are the entire agreement between you and Ironclad regarding the Simulator.

17. Governing law

These Supplemental Terms, and any claim, dispute, or controversy arising out of or relating to them or to your use of the Simulator, are governed by the laws of the State of Wyoming, without regard to its conflict of law principles, except where applicable law requires otherwise.
